INSPECTION DATES: Items are located at the City's maintenance shop located at 800 City Shop Road, Orangeburg, South Carolina. Auction personnel will be onsite on May 20 from 1:00 to 5:00 PM to assist buyer's who need bidding assistance.

REMOVAL DATES: Wednesday May 21, 2014 from 9:00 AM to 4:00 PM

Please read the following terms and conditions, prior to bidding.

REGISTRATION: By registering and bidding for the auction, you agree that you have read and agree to abide by all terms and conditions contained herein.

Once you register for the auction, you will receive a bidding number via email. This bidding number is valid for all online auctions conducted by Burns & Associates, Inc.

After you register, when you place your first bid for the auction, your credit card number on file will be authorized for one dollar ($1) to validate the credit card. This is only an authorization, and it will be automatically credited back to your account.

Any bidder who does not comply with the terms and conditions will have their bidding privileges revoked.

PAYMENT: All purchases will be paid for by cash, certified funds or approved check.

CHARGEBACKS: Bidder agrees that under no circumstances will he or she initiate a chargeback.

SALES TAX: Tax rates are based on an item(s) location and are applied to the total purchase price. Buyers will be responsible for paying state and local sales tax on all purchases, if applicable. Sales tax, property tax and registration fees on any titled vehicle, boat, etc., are the responsibility of the buyer and are to be paid directly to the appropriate government agency. All buyers must pay sales tax, unless you have a retail sales license on file with us. Email or fax a copy of your retail sales license PRIOR TO BIDDING in any auction for which you wish to be tax exempt. Total invoice amount will include the bid price and sales tax, if applicable.

AGENCY: All transactions are between the Buyer and the Seller. The Auctioneer is acting only as the Seller’s agent.

BIDDING ERRORS: If you mistakenly increase your own bid, place your bidder number in the bid field, or make any other gross bidding error, you must contact our office immediately by email. If an adjustment is made to your bid, you must remain the high bidder.

We will not reverse bids that have caused another bidder to be outbid. We will not reverse bids after the auction has closed. No exceptions.

EXTENDED BIDDING: This auction uses an extended bidding feature. The closing time of a lot is automatically extended 5 minutes whenever a bid is placed within the last 5 minutes of the lot’s closing time. The bidding for the lot will close when a period of 5 minutes has expired without an additional bid. Some auctions will close more than one item per minute, if extended bidding does not occur.

BID NOTIFICATION: Each time you have been outbid you will be notified by email until the close of the auction. To quickly review your bids and see if you have won you can utilize the 'review bids' feature. Items on which you have been outbid will be clearly marked.

WINNING BIDDER NOTIFICATION: An electronic receipt will be furnished to each buyer at the conclusion of the sale.

CATALOG DISCREPANCIES: You are bidding on the described item not the photograph, so always read the item description. Occasionally, the wrong photograph may be displayed, or for demonstration other additional items may be pictured which do not sell with the current lot. Please inspect the lot numbers and read the descriptions.

"In the event that a Seller has withdrawn an item from the sale prior to the close of the auction, Auctioneer may leave the item on the catalog and "buyback" the item on behalf of the Seller to establish Auctioneer’s earned commission and buyer's premium due Auctioneer from the Seller.".

RETURN / REFUND POLICY: ALL SALES FINAL, NO REFUNDS.

WARRANTY & CONDITION OF ITEMS SOLD: All items are sold "AS IS, WHERE IS, with NO WARRANTY expressed or implied. ALL SALES FINAL. Unless otherwise noted, you are buying used merchandise. Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition or use of an item, please bid accordingly. Item descriptions and conditions have been derived from sources believed to be correct; however, they are not guaranteed by the seller or the auctioneer. RELY ON YOUR OWN PERSONAL INSPECTION. The failure of any bidder to inspect, or to be fully informed as to the condition of the property, its age, value or other determinative factor will not constitute grounds for any claim or demand for adjustment, refund, termination or withdrawal of bid for item/lot terminating the contract of sale.

REMOVAL: All property shall be removed from the premises during the time specified for each individual auction. If not removed, items may be resold with proceeds going to auction company or may be shipped at buyer's expense. A fee will be charged to the credit card on file for shipping and packing. No refunds or charge-backs will be granted due to a lack of removal during the designated times. Auctioneer does not provide transportation, labor, equipment, tools or supplies needed to package or remove purchases. Please bring sufficient equipment, tools and labor. Purchaser is responsible for proper disconnection of all appliances. Rates are set by UPS and The UPS store for shipping and packing and costs will vary based on item size, packing materials, and destination. FAILURE TO PICKUP ASSETS: Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid email receipt. Please confirm that movers or anyone picking up items on your behalf have your paid receipt at the pickup location. No items will be released without a paid email receipt. Bidder further agrees to be held personally responsible for all purchases made on their bidder number, and agrees that bidder will not charge back items which are not picked up during the published removal times.

DAMAGE: Any damage caused by a buyer during the preview, or during the period of removal must be made good by the buyer causing the damage. Buyer agrees that the credit card on file will be charged for any expenses and/or repairs to the pick up location or property of another buyer.

IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or abandoning, (at the expense and risk of the purchaser), items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection, transportation and storage expenses associated with delinquent accounts or abandoned items.

LIABILITY: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.

CLAIMS: The parties agree that any controversy or claim arising out of this contract, or any related dealings between them, must be resolved by final and binding arbitration, with no appeal permitted, except as provided by statue. The parties voluntarily waive their rights to seek traditional remedies in any court, including the right to trial by jury. The prevailing party will be entitled to collect from the other its costs associated with the arbitration, including reasonable attorney's fees. This contract will be construed and governed solely in accordance with the laws of the State of South Carolina. The exclusive venue for any controversy or claim between parties will be in the County of Lexington, State of South Carolina.

Bidder accepts responsibility for and agrees to indemnify and hold harmless Auctioneer and their employees, governing bodies, officers, owners, affiliates, subsidiaries, directors, agents, and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs, and expenses related to, arising from, or associated with a buyer, his agents or representatives, use of this site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder or this user agreement or any use by bidder of the site or as a result of a dispute with another bidder.

AUCTIONEER’S DISCRETION:
Auctioneer has full discretion to modify the date and time, order, and details of the sale of any asset or conduct of any auction for any reason or no reason at all, including but not limited to technical issues, emergencies, and convenience of auctioneer or the seller.
